Se remitió el expediente al Tribunal de la referencia para que defina cuál de los dos juzgados penales municipales es competente para conocer de la tutela incoada por el accionante contra Saludcoop.
Lo anterior, explicó la Corte debido a que los dos juzgados son del mismo rango y la decisión sobre el conflicto de competencias negativo, debe ser adoptada por el superior jerárquico común, pues la negativa de conocer sobre las acciones de tutela se fundamenta en razones de competencia territorial.
